In Michigan, can a judge and prosecutor threaten, and make good on a threat, to withdraw a plea bargain, including recognition of time served to reduce the amount of jail time, if an indigent defendant is unable to get $150 from family and friends to pay a court fee (they are calling it a prosecutor's fee, I believe) prior to sentencing? Doesn't seem just to try to put this burden on innocent and uninvolved family and friends (who are already assisting the defendant with her basic needs) or treat the defendant unjustly for a fee she has no resources to pay until she is released and can work to pay off court costs and fines. Don't want to lose her the plea bargain and time served, but also don't want the judge and prosecutor to feel they can get away with this.
