hi, can a US citizen of indian origin defame an indian relative and get away with it? what actions can be taken against such person in US and in India. |

If the communication rises to the level of defamation, then the remedy could be to file suit. The problem with these types of cases, however, lies in the measure of damages. In other words, after years of litigation and thousands of dollars in legal fees, you could walk away winning the case with an award of nominal damages (i.e. one dollar). This amount to an obviously hollow victory. The best next step would be to speak with a lawyer to see if there are grounds for pursuing litigation. I agree. If someone publicly says or writes anything factually untrue and it damages you, you indeed can sue for slander, libel, defamation, interference with business relations etc. -- or at least threaten to do so and give a warning.

Defame how? Verbally? What was said and is it the truth? The truth is a legal defense against lawsuits alleging defamation.
