I have a lien against my fathers car and a note showing term and listing me as the first lien holder . the sheriff came to my dads house and said he was going to take the car he was informed that I had first lien rights and I was going to reposess the car to to save my collateral he stated that I could not Repo the car allthough my father hs mad no payments the judgement is old and is not against the car is it legal for me to repo the car the sheriff said if I did he would lock me and my dad up. thanks we are in NC

You can but if they take it to court and your lien is not real and for real value you could be fined or even charged with fraud.
