Student In Need Of Help
Hi There
I am currently located in Texas and an intersting situation has arose today. I am not an employed at all. I am currently going to be starting a clinical rotation in my program I am enrolled in. I found out today that I would be required to pay for my drug test in order to even be allowed to start my clinicals. How can they ask me to do such an invasive procedure if I am not an employee? I understand that if I was in the clinical situation and was chosen "for cause". However, I do not understand this as a condition of clinical situation if I am not an employee, receive no personal monetary gain or benefit. I object to the fact of having to take a drug test if I am not defined as an employee under Texas law. So how can they legally ask me to take a drug test that is invasive and pay for it out of my own pocket? Can they legally do this? My gut is telling me No! No! No!. Please any advice or where I can look to obtain remedy for this would greatfully be appreciated. |

They can demand it if there are any concerns that drug use could impair you or cause damage etc.--or even as a condition of participating if you have advance notice and the option to not participate. But normally they have to pay for it if they want it. |
