Default Civil suit for property sold without my permission

My husband and I lent a high-powered generator to a "friend" so that he could fix a piece of equipment that had broke down on him in the field. We later had a dispute with him and requested he return the generator. He refused to communicate with us and would return phone calls. We filed a warrant against him and won judgment because he didn't show up. We filed a request to the sheriff's office to recover our property and he told the sheriff that he no longer has it. I don't know if he sold it our is hiding it somewhere else. Should we sue him for selling property that wasn't his or just file a garnishment to recover the monetary value of the generator.

He also told the sheriff that the reason he wouldn't return it is because we owe him $6,000, which we don't. I'm not sure what we should do. Any advice??

You can collect the judgment amount however you wish and however easiest for you.

See http://www.worldlawdirect.com/article/935 -- Collecting on a court judgment.

Or did you just get an order to return it? You may have to have the damages amount set by the court too.
