Question custody

my ex husband and I have been divorced for 7 years. We had a joint custody agreement. He had the kids every other week. It lasted about a month . the kids have lived with me full time ever since. since then he has been in and out of jail. He hardly has any contact with them. Recently he found out that I am allowing our 15 year old daughter to date and he doesn't agree with me about this situation at all. Is is now filing for full custody of our two children who are 13, and 15. My question is can he envoke the custody agreement again after so many years of no contact?
