Child Custody
I just recently had my daughter to a man whom I was not married to and we are no longer seeing each other. Our daughter is 17 days old and the father, who we both think is the father, paternity has not been proven, wants to take her one week and bring her back to me for a week. I don't feel this is appropriate for a newborn. He has only seen our daughter 4 times since we have been home and only two of those times has he really helped take care of her. He lives with his parents where they take care of 6 other children, their are only three bedrooms and I don't feel this is a safe environment for our daughter. He does not have a job right now and has two other children who he is suposed to be paying child support for. I don't know what to do and I don't want to lose my baby for an entire week. Would a judge even consider this for how young she is? I need some advice on what I should do.

A judge would no way allow the baby's father to see the child without you being there and would not allow the baby to spend any time away from you. The child is far too young and it would not be in the child's best interests. I am not an attorney but am familiar with the family court system in southern California.
