Exclamation Mother is an alcoholic, help. She was taken to jail for violation of her probation.

My husband and i have been going to court since September 2000!!! And we are still going. Our situation is my husband has custody and mom keeps dragging us into court for everything, visitation modification, custody, you name it. Now we are going back to court next month because on the last visit she had his daughter called crying , and he sent a police officer over to check on her and also the child's mother probation officer, she registered 0.17 and was taken to jail for violation of her probation, and he had to go and pick his daughter up at the police station, she had a visit this day from 9am -7 pm, and all this happened at 10:30am.

The problem is that the court keeps giving her time with her child unsupervised and it makes us very upset, she is an alcoholic , and they have taken her visits away and she has had supervised visits and also no visits , and this has been going on for 8 years, now they are saying they do not know what to do with her, my husband is facing contempt of court because he said he will not send her back if she continues to drink while she has their daughter.

It is in the court documents that neither party shall consume alcohol while the child is with them, and this has happened more times then i can count that we have to go and get his daughter , because she has been drinking.

What can be done to stop this in a legal way? Is termination of parental rights ? or can her visitation be stopped?

There is a lot more to this story , we need help very bad.

Does your husband have an attorney?
If he does he should speak to his attorney about filing for at least contempt and supervised visits, or for termination of rights.
If he doesn't have an attorney, he really needs to hire one to make sure that his child is protected.

Yes, my husband has an attorney, but all he can say at this point is that they do not know what to do with her. I think that there is more that we can do, but no one is willing or trying to do anything else.
We have had supervised visitation before , and then they stopped that becuase she straighten up for a whole eight weeks!!
And they( attorney) that we can't file contempt or terminate her rights, and no one has ever mentioned protecting the child.
We just are at a point know that we are not even sure what our rights our.

I could really use some help!!!!!!!!!
As i was saying before we have done everything possible, and nothing is working through the court system.( Or should i say attorney) I really need to know if there is anything else we can do?
We have tried supervised visits, no visits( she will drag us back into court) limited visit time and still she continues to drink when she has the child, she just won't stop!!!
Like i said before that last time (August) she had a visit she was found to have been drinking and blew a 0.17 and she files for a emergency hearing in december and they gave her more time, and we just went back to court for a status hearing and they gave her every sunday for 3 1/2 hours until we go to court . Like i said we need help, court is in 2 weeks!!!!!!!!
