When I divorced from my wife, I did not notify my employer and verbally agreed outside of what the divorce papers stated, to keep my "family plan" medical insurance so she would not have to pay for an expensive personal insurance policy and just deduct a portion of what comes out of my check each month from her support. Now that she has gained insurance through her employer, she is now coming after me for the money I shorted her over the past 2 1/2 years. Can she do this?

Unfortunately she can try yes.
You cannot make other deals outside the order--the order governs. But show the judge what you two agreed and the judge may side with you. But remember abide by the order or get it changed if this type of situation occurs in the future...this happens all the time! |
