Default Changing custody without going to court?

My husband and I want to have custody of his son. The son currently lives with his legal guardian (she is not his mother). If all parties agree (incl the mother) and there are no disputes would we be able to change custody without going to court?
If so, where would we find the correct forms to fill out? Does it have to be notarized by a lawyer? Does it have to filed at a court to make it official?
My stepson and his guardian resides in Indiana. Would it have to be filed there?

If everyone agrees to the change, you can file for a modification of the existing order and attach the stipulated agreement to it, asking that the court modify the existing order by incorporating the agreement into it.

It has to be filed in court and signed by the Judge before it will be legal.

The papers should be filed in whatever court has the existing court order.
