Default Visitation-- Help

Hi My husband has a history of drug abuse. We are not currently living
together. Can I legally keep him from seeing our daughter until he is clean?
Also, he does not and has never paid child support.

Yes you can. Almost any court will support you on that if need be.

Or they will require supervised visits at least.

The answer is "maybe".

Is there any court orders at all for visitation or custody?
If there is, you'll have to obey those orders until they are modified.

If there aren't any visitation orders, yes, you can legally prevent visits, however he can file in court to get a visitation order.

Either way, it is not a guarantee, or automatic that a court will back you up. You will need to gather evidence to prove that he presents a danger to his daughter before a court will order supervised visits.

Is there a court order for CS?
If not, you need to file for one ASAP.
If there is an order, you can file in court to have the order enforced.
