I am fully-employed, single mother of a 14yr old girl who is wanting to try out living with her father and step-mother on a "6 mo." trial. She and her father were pushing for the start of this calendar year, but there was no major issues that would justify a partial-year move. I am willing to let her test this out once school is out, and if after 3 mos. she still wants to continue, to start school there (high school).
They have given me a form from their attorney for a stipulated change in parental custody which references the 6 mo. trial. From other information I have read, it has been stated that if a parent can get the child to change over and get established in their area for 6 mos., they have a better chance at going before the judge to request a change in custody. Is this correct, and would I be "setting myself up" for future deception? Please advise. Thanks! |

From my own experience, I have found that a Judge will keep the child in the home that he/she is presently in. So, if your daughter lives with her father for 6 months, there is a very good chance that your ex will be able to get full custody.
I completely advise you against this. You may want to consider longer visitation for a while before you agree to such a big change. Even then, however, the Judge will likely continue enforcement of that visitation. Judges like to "keep things as close as to what the children have grown accustomed to". Good Luck |
