I left my ex-husband 6 six ago and have full custody and was granted child support. Ex has never paid a dime and actually moved provinces. He came back into the childrens lives about 2 years ago and wants to change the amount to $300.00 per month instead of $700.00. He came over on Mar.22nd 2007, and we both signed an agreement with his lawyers signature because I am raising three young children completely on my own, and I thought, I would take whatever he can give me. He has just given me all those documents that were signed almost a year ago, and told me that in order for them to go to court, I would also need a lawyer to sign them. Just so that you know, he has never had visitation rights but I have freely given the children to him whenever he wants, which is probably once every 6 weeks. I know he did not pick up the papers from his lawyer because he did not want to start any kind of payments. My question to you is: how long are those documents good for? Can I renagotiate them? Is it true that after one year of him not persuing them, that we need to redo them? With my original court order, I had childcare costs, and latchky, and colleges and universities and I overlooked them when I signed them. He has not made any payments to me in any fashion, nor with purchasing not even a pair of shoes for his children and I beleive that he should. He is hounding me to get these documents signed by a lawyer so the courts can proceed, but are they legal if they haven't gone through the courts yet? Thank you so much God Bless

As to the court ,the court order is still the document that governs.
You two can go back and agree and have the court agree as well. But you can enforce the court order until it is changed. The contract you made could be binding as a civil matter however. You may want to take him back into court and get this cleared up and have an order in place that you can enforce given today's circumstances and your situations. The doc you signed does not run forever, normally you would have agreed how long it was to govern |
