Confused definition, please

In a child custody case it was Ordered by the judge that the father was
awarded physical custody and both parents were to retain joint legal
custody. It further states that if the father is away (specifically
deployed by the US Army)then "Defendant/Father shall provide a Power of
Attorney to Plaintiff/Mother if she is available and qualified."
My question is,the mother has had the children taken from her by the Department of Human Services for neglect/endangerment (enviromental), so who/what defines "qualified"?

BUT, the fathers attorney advises the father to give temporary P.O.A. to the mother, stating that the Department of Human Services has/will be closing the case soon. I have heard that DHS is not 100% happy with her progress but since she is no longer in physical custody of the children they have no case with her. Then I had also heard that she would be watched for up to a year by DHS and her name would be retained on some 'list' that other DHS could access at a future date. Since her name is on this 'list', if such a list excist, wouldn't that still make her unqualified? And if that is true, why would the fathers lawyer be advising the father to go ahead with the temporary POA?
