Child support father with several problems
I'm having the' and I'm talking THE' worst time trying to get my son's father found. He is using several different names, including the "alias" he used to sign his son's birth certificate. Unfortunatly I have tried to tell my child support caseworker that he is using an "alias" and she just tells me; "Give me legal proof and then we will proceed." How can you get legal proof of a fake name a person is using? He was arrested by the name he signed the birth certificate with. But his real name is being used right now to skip child support. He has skipped for 3yrs to the point they have given up on my case and are now closing it. I have found him yet again, and I'm afraid to give them the results of where he is living. The problem why I do is because the last time I paid out of pocket for an investigator our caseworker called him up. Giving him just enough time to run yet again! So why should I give her the information now? Could I sue the county if she proceeds to not listen to my plea's of help, so he doesn't run again? Or could he be paying her off in some sort of way to get out of child support? What should I do? I was even told by several of those "Dead-beat Dad Finders" that they were unable to help due to my situation. I can't afford a lawyer. And my husband just wants him to sign papers now stating that he doesn't want anything to do with his own child, so that my husband can be his real father. I just need a foot in the right direction. Can anyone help me?

I'm not an attorney, but I am a mother with a child from a first marriage. In my case, the father is present, gets regular visitation, and mostly does not pay child support. He continually gets his hands slapped with no real motivation to pay. My second husband would love to adopt my daughter, but he can't because my first dummy won't agree and he does still have visitation with her. My dream is that he would just go away and I would not even care about pursuing him for support.
If your ex is on the run, does not see your child, and has not paid child support, I believe there is a time limit for him where you and your new husband can petition the court and get your child adopted without permission from the ex. If you care more about the adoption and getting rid of the ex than you do about collecting child support, I would check your state laws for the time limitations. In my state, (it's been a while since I looked), but is something like if he is at least 1 year behind in child support and has not seen or contacted the child for 6 months, you can petition for adoption without his input. I'm sure there are requirements for attempting to serve him papers to have a chance to refute the petition, but if he is running that hard to avoid support, it doesn't seem likely he would show up to oppose your adoption proceeding because then he would face the support issue. Hope that is helpful. Best of luck to you. |

Do you have custody of the child that moved in with you by order of the court? Is the support you have been paying by order of the court? The best way for you to reduce whatever you are paying your ex-wife is to be sure that you have custody through the court and then a new support order from the court, taking into account that she has full responsibility for one child and you have full responsibility for one child. Make sure you address the visitation arrangements as well since that will make a difference in the support amount. As should always be the case, take into consideration that whatever you are doing is in the best interest of both children.
