Insurance Repayment & Drop Off Times
Ok my first question
In my divorce decree this is what it states: "It is further ordered, adjuded and decreed Plaintiff (me) shall maintain medical insurance on the minor children until said minor children reach the age of eighteen (18), or if still in high school, until the age of nineteen (19) or become emancipated. Defendant (ex) shall reimburse Plaintiff one-half (1/2) of the health insurance premium or $30.00 per month due by the 15th of each month beginning in June of 2006. Plaintiff and Defendant shall each pay one-half of all medical costs and deductibles not covered by insurance on the 30/30 rule." Here's the question pertaining to this statement. Does this say that he only has to pay $30? I have indenpendent health insurance now, which costs $249 per month to cover my two children. So doesn't he half to pay me half of the $249. My second question, also stated in my divorce is that we have to drop our children off at daycare, they have to be dropped off by 8 am. My ex is constantly late, by at least 10 mins. What rights do I have to pursue him for violating the court order? |

Are you saying that your insurance through costs you $249 to have your kids covered under your insurance per month? (Are you included in that cost?) Make sure you know the cost ONLY for your kids...then technically yes he owes you half of that. Now about your second question... Personally, I don't think I've ever dropped my daughter off at daycare at the sametime everyday. 10 minutes is not bad....I would say if it was 30-60min late than I would suggest talking to him about it first. But seriously, 10min??? Choose your battles carefully. |

I had them on their own plan, I was not included on the plan, because this particular insurance company would not insure me because I have pre-existing conditions, so I just insured my two children.

Then he should be responsible for half of the premium.
