Default Florida Law

Is there csae law that a father can take an extra job to pay legal fees and not have htat income counted against him for child support modification purposes.

I am not aware that you can separate that income like that...

You could ask world law direct to research that nationwide for you--they may do so

Possibly, depending on the father's circumstances.

Does the father have any other subsequent children that he is supporting?
If so, and he can prove that a second income is needed to support those children, the answer is yes. Here is the Florida Statute relating to income from secondary job:

Fla Statute 61.30
(12)(a) A parent with a support obligation may have other children living with him or her who were born or adopted after the support obligation arose. If such subsequent children exist, the court, when considering an upward modification of an existing award, may disregard the income from secondary employment obtained in addition to the parent's primary employment if the court determines that the employment was obtained primarily to support the subsequent children.
