I want my baby back

I am a recovering alcoholic. I will have 4 years on Feb 21. My husband said I had relapsed (not true). He took my son claiming that he is keeping him out of harms way and moved in with his ex-wife. The court gave him temporary custody while I have supervised visitation 10 hours a month. I have been taking random drug and alcohol test for the past 2 years, passing all of them. He has said that he wants to have my parental rights terminated. I know for a fact that will never happen. Due to all of my husband’s lies, I am going back for custody.

Would the lies and the assaults listed below increase my chances of getting custody? If so how much?

1. Husband was arrested for assault on me the day after he took Joshua (son). I didn’t pursue it and it was dropped.
2. my husband was arrested for assault on his ex-wife (during there marriage)

3. His ex-wife was arrested for assault on him (during there marriage). Both of these were about 5 years before they divorced.

It will be a factor yes.

But you own health and welfare are the most critical--make sure that you have no negatives they can use against you now.
