Default Forcing away parental rights

I have an eight year old daughter by my ex-husband who never sees her, talks to her, and has never paid child support. He is a drug addict who is constantly in and out of jail, rehab, and half-way houses. I worry about if something should happen to me, he would then be her gaurdian. Is there a way I can force him to sign away his parental rights?

I'm not a lawyer, but i have to ask .... has he ever been busted with drugs? Does he have a record because of drugs or abuse? Is there any way at all that you can prove him to be unfit as a father? Has to be "Prove" as in evidence of something because in this day and time peoples words mean nothing, sad but true. I would think that if you can prove him to be unfit then you might have a good chance of having his rights removed. Have you asked him if he'd be willing to sign away his rights? Not to be evil here, but i can understand your concern here, any chance you might can play nice and catch him while he's strung out or something and get him to sign some already typed up paper work? Hey not your fault if he signs something and he has no idea what he's signing. That's why people shouldnt do drugs or drink to the point that they dont know what their doing.

That is bad advice about having them sign something when their messed up. Not only is it illegal but worthless in court. Go by the book and if they don't have a record make sure they do by calling the cops next time they are doing drugs. He needs to understand the effects his actions have on his child and needs to get real help.
