!!back child support

My partner owes back child support for his son, whom his ex wife never let see the past 7 years. In the years he didnt pay support, his ex wife never asked for it, and at times, he wasnt working. He is stable now, and has a good job, and has been payng his payments on the dot. She now wants him to sign over paternal rights, which he will do, because it is within his sons best intrests. But this debt,in which he didnt evn know about till they tld him he woed 25 grands worth, is stopping him from doing anything. Is there a way to get the back support overturned?he is american

Did his ex ever collect any public assitance?

IF she didn't, she has the right to voluntarily "forgive" the arrears. This is usually a very useful tool in trying to convince a NCP to voluntarily relinquish thier rights.

However, if the ex ever did recieve public assistance, all, or a portion of the arrears is owed to the state and the CP cannot forgive that.

My husband is in the same situation. He just received papers from her lawyer today for him to sign over his parental rights so her husband can adopt the child. It says in the paper work that all rights, duties, obligations icluding child support will cease to exist. Does this mean that he won't be responsible for the arrears also. Or does he need something from her stating that she will forgive any arrears owed? It also says that the lawyer will send us a final copy of the adoption papers so that we can provide it to the court to terminate support. Shouldn't their lawyer be doing that? Please help!

im not too sure on whenter she received public assistance. She is however in the military, and was at the time also. Does this make a difference at all?? being im Australian, many things are very different in my country, so forgive me 'dumbness'as u will. Thank you for the reply also.
