Unhappy isnt this fraud??

I have two sons living in Alaska with thier mothers parents. Last time i wanted to see them, the grandparents told me it'd be a cold day in hell.. so i moved on with my life. its been 13 years now. Only a few years ago, i started getting child support papers in the mail. my support order says shes the custodial parent, but according to my sister who is in contact with the boys rather often, theyve been with thier grandparents for quite a while. She lives 10 minutes from the grandparents house in Anchorage. Recently i found thier mothers profile on myspace, and it says she lives in Ft. Wainwright AK... How could the state of Alaska NOT know that she doesnt even live in the same city as the children??? Furthermore thier mother and i are both of native american decent, yet im ordered to pay for health insurance for the children. Yet my first son was born, free of charge, in the Anchorage native hospital.

Can they really make me pay for something the children already get for free??

Im not very well versed on law of any kind, i could really use some answers.

I was under the impression that child support was filed either by one parent against the other, or that the state filed it when the parent with custody, sought public assistance. Is this wrong? and if im not wrong heres another can of worms. Because of my EXs native heritage she got 20k or so from her tribe on her 18th birthday. right after she recieved that we moved to Arkansas, and while we were there she put several thousand into CDs at a credit union. Not long after i was forced out of my kids lives, she was working at a hospital, but was fired after making false accusations of sexual harrasment, and if i recall correctly she then went on public assistance. IF at this time paperwork for child support was filed, she didnt claim those CDs, otherwise she wouldnt have recieved the assistance.

im just throwing everything that i can think of out there, it may or may not be relevant.. please bear with my sparadic thought processes.

I spent a couple years around her and her family, and i know her father is one of those "stick to the man"/conspiracies everywhere, kind of people.
and i really dont think my childrens mother is above filing fraudulant information to get anything extra from anyone willing to overlook her frauds.

cant all this be "audited" or something??

i mean SHE LIVES IN A DIFFERENT CITY THAN THE KIDS!!

i was young and dumb, and they packed my stuff, threw it on the curb, and moved her in with them where they could police her activitys, while i was at work. and they refuse to let me see or talk to, or even write to the kids.

I currently have 3 kids with a woman i wont marry, because then my child support debt, will become hers. Its been 8 years now. I work as many hours as humanly possible, but considering i was on disability for 3 years, and child support sucks most of my checks, were barely treading water. So im not able to hire a lawyer, or even pay for a consultation. If i had the means to bring them to live with us we absolutely would, but getting half paychecks and absolutely nothing back on tax returns has really messed up our plans for a home to be able to do so. Living paycheck to paycheck on half of what i earn is hard enough for 5 people , and its certainly impossible for 7 people.


can anyone offer me advice? Helpfull or not i need to hear it.

You still do have support obligations for general monthly support if the mother has the child or is taking responsibility.

But you could challenge some of those medical issues it would seem

I suppose you could call what ever agency and advize them of what you know.Also let welfare know what you know.Idont understand her being able to legitmately claim support if she is not custodial parent.But im sure that goes on alot as long as nobody says anything.It dont make it right.

No. In Washington state the medical is waived if your Native American. Contact the person mentioned on all the paperwork they are sending you and inform them that you and your X are and that they are covered. They won't make you pay for it.

My guess is that even tho your X obviously didn't claim the CD's (or even if she spent the money) I don't think it would have any bearing on your case. (I suppose if things got nasty you could turn her into welfare agencies but why? the past is the past.)

Well in a way yes. Contact the same caseworker I mentioned above (they should be named on all the paperwork) and ask for paperwork called "Hardship Request for Lower Withholding" In it you will list all of your assets and often times the child support amount is lowered. You can also find it on this page download it and fill it out and send it in - and see how things go.

Child Support Forms

If your sister is willing to provide you with information regarding the whereabouts of your children in contrast to the whereabouts of your X I'm sure they will consider that however, they probably will still collect and send it to the grandparents if that's where the kids live. (BUT they also may collect from mom as well and send that money to the grandparents also)

And lastly, ironically you'd probably do better marrying the woman your with. (More taxes for one...) The three children can be listed on the form even if your are a step-dad. List the lady you live with also - your child support owed will never directly become the responsibility of your lady nor will it if you ever marry. They will ask you about her income but will not consider it unless you are requesting a really unique way of dealing with child support. (as far as I know anyway someone correct me if I'm wrong...)

Hopefully that covers it. Understand that if you can contact your X you may be able to barter this out with her explaining that she won't get any money and she probably will have to pay as well. Considering that she may be cutting off her nose to spite her face.
