Exclamation unwed criminal custody

My niece's ex-boyfriend is in prison. He has told her that when he gets out he will see his son no matter what he has to do. She says that he will get custody every weekend. He has never paid child support. He wants his mother to start paying the child support until he gets out so that he can get his son. My niece does NOT want him to have anything at all to do with him. She did'nt give the baby his last name and did not put him on the birth certificate. He is a drug addict and can't seem to stay out of jail, does he have a chance of getting any kind of custody?

It's dubtful on the full custody part. However, what he'll need to do as soon as he's released will be to file with the court to establish paternity/CS/custody and visitation. From your post it appears that he is not the legal father yet and therefore has no legal rights until he goes to court.
