Confused Please Help, Father wants son

My son will be 2 in February and the mother refused to let me sign the birth certificate. She has used him as a pawn and has refused me visitation if we are not together. I recently went downtown and added my name to the birth certificate and tried to get a full custody order, all I was granted was Monday night from 9pm until 3:30 pm and the same arrangement from Wednesday night to Thursday. The first night I picked him up she gave me trouble, and said she would not release him to me. I called the police department and she released the child to me. She will not give me any of his medical information and refused to let me take him to his doctor's appt that she scheduled on my time with him, instead he did not go to his appointment. I am worried for my son, he is barely talking and can only say a couple words. I want to get full custody of my son for him to live with me and my fiance. She did not show for the manditory class we were scheduled, and she is using my son to get child support out of me. She said I was not allowed to use any of the stuff she has for him, like a car seat clothes and diapers. I have everything I need for him anyway, but is she allowed to do that if I am paying child support? It would be in the child's best interest to live with me, what can I do? We live in Pennsylvania in Allegheny County, I live with my fiance who is pregnant due in March 2008. She has tried every time I have picked him up to change my visitation with my son and has made every excuse she could, I have him Christmas morning and she is asking me to have him home by 9am when I have him until 3:30 pm.

From your post, I gather that you do already have a custody and visitation order, correct?

If you do, and Mom is not obeying the order, you can file for contempt. In the mean time begin to gather the evidence you plan to use later when it's time to file to modify the custody/visitation order. It will probably take awhile and it might take a couple trips to court for contempt, but time along with gathering eveidence will give you a better shot at residential custody than if you file now.

Thanks for your reply, I appreciate it, and yes there is an order but that is all I got, how do I get more than what I have through the modification? It went from no custody order at all to the way it is now, and I think I should have more than that, and I have all the evidence showing that she is an alcoholic.

judges also use wedlock if other parent really pushes it u need to be married or she can use that against u im in same situation they can keep over night visitations out because of that whether engaged or not even her being pregnant most judges dont care .They dont care if your 18 0r 35 wedlock can be used against an unmarriend parent especially if boyfriend or girlfriend is living in thy residence Please note that.

Although this for some reason may have happened in your particular case, the legal fact is that it doesn't matter if a parent is married or not. The law does not allow for discrimination of any kind regarding wedlock and visitation rights.
