Default new york law

if there is no custody agreement according to the state, is it illegal if one parent takes the child out of state permantly without telling the other parent.

what is the legal aspect of this?? is it considred kidnapping, or can it be done.

I don't believe it is illegal...however, I wouldn't suggest it. The other parent could go to the court and file papers for visitation and Child support and could ask the court that you bring the child back to the state that you have left. Now, if there are domestic issues, I would suggest you go through the courts rather then trying to handle it by "running away" (so to speak). Plus, if you go to the court you could be getting child support (to help with food/shelter/and clothing for your child) and the child would be able to see their other parent. (Unless, of course there are domestic issues).
