My ex husband and I got divorced through a simplified Guam divorce. He is military and is getting ready to change duty stations and go out of state. The divorce was amicable and uncontested. Our 3 children were living with me but I let them go live with him thinking they would be in a more stable environment and would get to spend time with their dad. I had the understanding that should my situation change, and the children wanted, they could move back in with me. I never gave up custody. We have an agreement that states that we both have 50/50 custody. Now, he is in the process of getting divorced again, he has moved the children 5 times and switched schools 6 times, he is attempting to move the children out of state; without my permission and the kids want to move back in with me. I am trying to fight for custody but the court says they aren't sure who has jurisdiction. Our divorce papers talk about the divorce only. The application says that the child custody is not under their jurisdiction but the final decree doesn't state anything about child custody. We have a separation agreement that he came up with and we both signed but it isn't signed or stamped by a judge. Does anyone know if these simplified Guam divorces differ jurisdiction to the state of residence or what? I need to know what to do to take the next step. Thanks for any help!

If the divorce did not adress the issue then you have to file and get a new ruling.
Guam technically has jurisdiction but if neither of you are there then your local US court should take it now. If the other side objects they can argue why they want it back in Guam. World Law could assist if need be--contact them |
