Confused I started receiving disability, now my ex is taking me for more child support

I am a mother of 2 children. A 13 yr. old son and 10 yr. old daughter. They both live with their father. We have been divorced for about 8 yrs. and everything was fine until now. In the beginning of this year I started receiving disability and my children get benefits too. Now my ex is taking me for more child support. Recently I found out that my disability will decrease because of medicare payments which I need. I need money to live on too. He lives with his girlfriend that has 3 other children and I feel that he needs more help. They are not my concern. Only my 2 kids. I am married again and my husband supported them for 4 years because I did not work. Now with this happening with my ex my husband has filed for divorce. Does he have a chance of getting alot of support from me? Any advice?

Your ex husband may be in for a surprise, it's very possible that your CS will decrease, not increase the way he thinks.

Usually any SS benefits recieved by/for the children on a NCP's disabilty gets credited toward whatever the NCP's amount of CS will be. An example- NCP's CS based on guidelines would normally be $500 per month. Children recieve $400 per month in SS benefits- the NCP would only have to pay $100 per month. In some cases the SS benefits are more than the CS amount, in those cases the NCP wouldn't have to pay any CS.
