i need my child safe

i need my baby boy safe and for him to live a stable life.

my wife was three months pregnant before we were married and was living with her parents.we then got married. we were together for two months, her father hated me and hated our marriage, we split eventually after two months because of his actions. shes living with her parents for four months now and our baby boy has come into this world this month. her father is an abusive man, really abusive. i came a couple of times to fetch her but he hit me and beat me up ,i layed a charge against him and he now has three years probation , he threatens my life and beats me up everytime we speak. but i didnt lay a charge knowing the next charge would be jail for him. my wife wont come home until he gives his blessing but i know that there is no hope for that. i want my child out of that dark home . what do i do legaly guaranteeing 100% that i will win this case to have my child safe and where he belongs.

will a restraing order be a good idea? could i lay a restraining order for me and my baby boy against my father in law?
