HI all,
Just a query as to wether Child Support can be enforced on a payer ( parent)in Australia from the payee in Canada if there were never any agreements or orders made......further more I would like to know if the prospective payee in Canada can seek orders without any consultation or agreement from the payer in Australia concerning two children aged 15 and 16. The payer would like to come to an agreement and honor that agreement to pay but the prospective payee is being unreasonable. Any advice would help. Thank you. |

You can get it going forward but you normally need a court order to start enforcing.

I'm not sure about Canadian laws...but I'm pretty sure in the states in can. You should contact your local court, they should be able to answer those questions-if not I would def. consider speaking with a lawyer.

Well legal advice is not an option right now....we dont have any money for that. Since hubby came to Australia we married and he put in an application for residency.It was not his intention to run away from Canada and skip Chils Support, for various personal reasons we decided it was better he stayed here. He tried to tell his ex that he would make up payments later for the kids but she has gone to a lawyer and told that lawyer that he hasn't ever paid her! He tried to enter agreements with her since last February and she has stalled it the entire time.He paid the house, the bills, child support and then some, more than reasonable leaving himself with nothing until he realized this is why she was stalling the agreements, she was happy for him to just continue on paying for absolutely everything....so he quit and paid only child support trying to get her to agree on something fair which would leave her with the house.That made her mad as hell! Some of the payments can be proven, some cant because he paid them into an already exisiting joint bank account and can't verfiy what the purpose of the payments were( silly to trust her in the first instance). Anyway....she has said he is running from his committments blah blah blah...not true, he paid her until he couldn't pay anything anymore...and any agreements she has come up with have been totally unreasonable...in that she wants to keep everything, assets etc and she wants him to pay for it too....she wants his share of any profits etc etc etc. I think her only real goal is to punish him ![]() If she could be honest....this would have been resolved already. Maybe calling the court house in Canada from here will help...if anyone has any idea of Ontario law that would be even better
