I am a divorced woman and my ex husband refused to be involved with my two children and has refused to take part in any financial and upbringing matters and has also signed papers that ensure this. My 13 year old daughter has been adopted by my brother, her uncle, who is an American citizen. She is currently living legally there with her uncle and has resumed the normal life of a child. She has enrolled in a school, etc. Now her biological father is insisting that she returns to her home country. Can he really accomplish this legally by going to America? Can he take her? If she goes back home later in the future by her own desire, being an American citizen, can he prevent her from going back to America?

your ex is no longer your daughter's legal father, he has as many rights to the child as i do-NONE. he cannot force her to go back to his country, and if he takes her, he can be arrested and charged with kidnapping. your brother is her legal father now, and makes all the decisions regarding his child. |
