neice and her daughter in spain

My neice moved to spain with her spanish boyfriend and there daughter in january this year. There not getting on and she wants to return home with her daughter however the boyfriend claims she cannot as the daughter is now a spanish citizen is this true and if so what can she do to change this,surely she should still have rights as a mother.

She can go unless a court orders her to stay.

If they cannot agree some kind of solution she may want a court to decide.

if she takes her daughter out of the country without the fathers permission she may find that the father will seek advice and look for her, then there is a possibility of your daughter getting done for illegal kidnapping which is a prison sentence. just be careful as i am in the same situation in spain.
