Is this going to be tough to get approved in court?

Thanks in advance.... I just broke up with my baby daddy we are currently starting court for child support and custody.. first court date being mid oct. I am CONSIDERING moving down by my father in florida. I want to know if the court would rule in my favor of moving from wisconsin to florida. My babys father is in his life we spit the week in half. we dont get along and my father is sick. id prefer that i be by his side seeing we are eachothers ONLY. I do have my grandmother and an uncle where i currently live. but we arent that close and i raise my son without them. My father can barely afford his place and is in need of some financial help. i figure i could get a job down there and split the bills with him. and be with him through tough times. Is this going to be tough to get approved in court seeing my baby daddy is still so involved with our son?!? again we have 50/50 custody right now. and i am just starting to think about this. <333 lonely lost mind |

I wish to inform you that if you would like to move the child from Wisconsin to Florida, then you may seek the order of the court in the matter. The court always considers the best interests of the child. You will have to show how your move to Florida would be in the best interests of the child. The court always wants the child to grow up under the care and love of both the parents. The court will consider all the facts and decide the matter.

If you are divorced, check your custody agreement. There may be a prohibition against moving out of state with the children or special stipulations. Make sure you are legally able to make the move.

You would have to show how the move would be in the best interest of the child. Which may be a difficult task as the father is involved, and the move sounds to be more for you and your father, which is none of the court's concerns.
You may want to discuss it with you ex if you feel you both can communicate effectively. Work with him to come up with a visitation schedule, transportation, etc. |

I see you having a tough fight with this one. From everything you stated, this "move" concerns you and your father. While I might sympathize, the courts won't. And I'm pretty sure the father won't either. If you were my ex-wife posting this, I'd fight you tooth and nail because nowhere in your post did I get the impression that your daughter would have a better life. I didn't even see you mention how it would effect her. Only you and your dad.
