My current wife tells me that the current child support ordered by the court isn't enough. She wants me write up an agreement and get it notarized that says I will pay, say, $200 per month when the judge is going to order, let's say, $100 per month.
Would something like this affect the outcome of the divorce itself in regards to how much child support I would have to pay? |

I wish to inform you that you may inform your wife that if she is not satisfied with the current amount of child support ordered by the court then she may file a petition to modify the child support. The petition will be filed in the same court which passed the present order as it has continuing jurisdiction in the matter. She may state her reasons for the request for increase of child support in front of the court. The court always considers the best interests of the child. The court will consider all the facts and decide the matter.

Do not do anything outside of court and do not violate currrent order. If Mom wants to raise child support then she needs to seek that through court and show good cause. a notarized piece of paper carries no force of law without a Judge's signature

Your state has support schedules which I presume the two of you have checked. One can always support their child in addition to what the schedules recommend, but it is not obligatory. A child with special needs, for example, requires additional support not included in the guidelines. It would be best to pay what you can and await for the court's order for support. |
