Default Custody... for legal status in the USA I had to go back to El Salvador

Hello.....my ex partner and I had a baby girl and we got separated, that was about a year and a half ago, and for legal status in the USA I had to go back to my country (El Salvador) I brought my daughter for like four months and now she is back with her mom, however she's been gone crazy and don't want me to not even talk to my daughter, how do I get the share custody at least since I've heard that she got a new boyfriend, they are living togeter and he beat her, not my daughter but the mom. we never got married and they resides in Maryland .....I'll wait for your answer THANK YOU

I wish to inform you that as you were not married to the mother of the child it needs to be ascertained if your name is on the birth certificate of the child. If it is not then you will first have to establish paternity. You will have to file a lawsuit to establish parentage by DNA testing. Once paternity is established, you can file a lawsuit for custody of the child and you will also have to pay child support. You may show to the court that the mother's boyfriend beats the mother and so sole custody should be given to you. The lawsuit will be filed in Maryland in the County where the child resides. The court will consider the facts and the best interest of the child and decide the matter.
