Default child support modification; i am currently active military

my daughters mother is requesting a modification - i have been paying the court ordered amount plus additional money every month for 17 yrs - i am currently active military - will the court take any of this into consideration before increasing the current order thanks

I wish to inform you that the other party will have to show a substantial change in circumstances for modification of the child support amount. You may inform the court that over the past 17 years you have paid an additional sum every month on your own besides the court ordered child support. You may also show to the court that after expenses the money left is not adequate to support a modification of the child support amount. The court always considers the best interests of the child. The court will consider all the facts and decide the matter.

Whether or not you pay what you owe, on time, is NOT something you get brownie points for (it's what's EXPECTED). Any extra money you gave over and above the ordered support amount was a gift, and you don't get credit for that, either.

If mom is requesting an upward modification, the court will consider the change of circumstances that led to her filing her request and decide it based upon how it benefits the child.

I'm wondering - since you mentioned that you have been paying for 17 years - how old is your daughter? What does your support order say about when the child support terminates? Is it upon reaching her age of majority, or does it continue while she attends college?

A parent's military service can present child custody issues. Military parents are risk losing child custody when deployed. If you're in the military, your service may present special child custody issues, and it's often best to seek a lawyer's advice.

The court will only consider the parents' income and the needs of the child. Paying on time is expected. I am sure your daughter appreciates your contributing more than the court ordered amount, too. The financial affidavits that are filed will be important in determining if modification is warranted.
