Default He's telling everyone that I'm a deadbeat mother and won't let me talk to her

Hey all my situation is difficult. About 2 1/2 months ago I called my child's father for help with my 2 year old he told me the only way he would help is if I stopped on the state and she lived with him..I agreed because I was struggling. I got a job, and all I want is to see her...for the first month I seen her every other weekend. And spent most of my paycheck buying her clothes and the things she needed. I kept all the reciepts and tried talking to her everyday on the phone...Now he's telling everyone that I'm a deadbeat mother and he won't let me talk to her or see her...There are a lot more details to this but this is a short story...I don't know what to do and I miss her...Someone please help..Thanks..

I wish to inform you that you can have child custody back with you. In this regard if the parents of child are not married and paternity is not established then you only can have child custody and if father refuses then you may inform law enforcement agencies. If paternity is established or parents were married then child custody can be taken from court. Court will consider best interest of child as main consideration.

When you say "child's father" does that mean the two of you were never married? If so, you have every right to have your child and he has none. Not until he has his rights established by the court by a paternity action.

There are several avenues you can pursue to get your daughter back. First, as mother you have legal rights to your child at this time exclusive of anyone else, including him. You can call the police and have them accompany you to retrieve your daughter.

If he wishes the rights of fatherhood, they will have to be determined, legally, by a paternity action. The court will order DNA testing, custody, support and visitation. IN light of the age of the child plus his actions keeping her from you, tantamount to kidnapping, but certainly custodial (parental) interference, custody should be with you. Considering his actions, should visitation be granted, you might wish to request it be supervised.

Without legal right to have the child, without a custody decree stating the child has rights to be with him, you should be able to enlist police cooperation to get your daughter back.

When you say stopping "the state" do you mean child support? If so paternity has been established.

If dad never went to court for visitation/custody you have sole custody and can go pick your child up any time.
