My husband and i separated 3 years ago i took our 2 kids plus the one i have from a past marriage, after realizing i could not support them i took them to him. Tell i could get my self a place. 3 years later i am a almost done with school and in a good place, but he will only let me see them on the weekends also he has my oldest son (from my old marriage) and he will not let me have a relationship with i feel he has brain washed my kids. He is a horrible father to them, but i just dont know were to get help with fighting for them i have no income at this point and i want my kids back. Is there a chance if i fight for them that i can get them back? I have no records with the police but he does also he is not even legal here.

I wish to inform you that you can have children based upon best interest of child as main consideration. You can have custody if you can show in court that now you can take care of child. You cam also seek child support in order to meet expenses relating to child. Alternatively you can also have child visitation so that you can keep your contact with children.

The child he did not father he cannot hold from you. Notify the police, as it is at least custodial interference.
As to your other children, you need to go to court to get an order for custody/visitation. Since you were married he has as much right to the children as you. |

You could use a family law attorney from what you state here. In any contested custody case it is always wise. But in this instance you have given the children to him for three long years, they are incorporated in his home and community and you will have to present a solid case of unfitness in order to get the two you have together back. Alienation is an issue and something that will have to be documented to the court. There are many factors the court considers before changing custody and/or residency of children. [Reporting to INS might be a tactical option] |
