Default ex drinking and driving with kids

My ex husband is on an online social network and is posting his daily drinking habits including where when and how much he drinks DAILY. The drinking has now esculated to days that our children are in his care and twice now I have spoke to our children and they have been in a car with him after he posts of having several drinks. My question is this...Will this social site printed hold up in court as evidence? It addresses his first name, place of employeement, and there are pictres of him on other sites at the places he posts he is drinking but the site does not actually say his full name or show a picture of his face. What can I do to protect my children?

I wish to inform you that court considers best interest of child as main consideration. If father drinks to a level where welfare of child is affected then modification of child custody can be sought. Photos from facebook can be shown and can support the arguments. Further statement of children and other persons known to both the parties can be taken regarding drinking habits of father.

Would the online printout showing his activity and detailed daily drinking habits (sometimes up to 8-10 a day) be enough to modify custody? When the kids are in his care he usually only has 2-4 drinks but he is never home and therefor must drive home after drinking. Like I said the actual account only shows a user id and does not show his full name or picture of his face however it lists person details of his life such as place of work, friends, girlfriend. However the user if he uses on this account is the same as twitter, facebook and email accounts that can be traced directly to him through pictures.

You might be able to use it since there is enough identifying information. He could always claim that he is joking and just trying to look big. Check with a lawyer.

The facebook posts you can use as evidence. About 80% of divorce lawyers now admit they use material gained from social networking sites for their cases.

The admitted heavy drinking is a serious problem if he has the children in his care. If I were in your shoes, I would most certainly follow up to see my children are safe on visits with him, even if it means suprvised visitation.
