Long story short...
G/f and I lived together then split We lived in Texas. She moved to missouri and I moved to VA. Our son who was 10 weeks at the time left with me. I filed for custody in VA. The mother went back to Texas just to file a writ of attachment to get the child back. I have a court date set in Oct in VA for custody. The court date in Texas is the end of august to see if the child should go to the mother. It is not a custody hearing but a court date to hear if the child should be returned to the mother (even though she no longer lives in Texas) Mother does not answer phone calls or emails or call to see about the child. What can I do? I was smart and filed for custody as soon as I got here. I am pretty sure VA will have jurisdiction b/c she no longer lives in Texas. By the time goes for me to show up in Texas the child will have spent 9 weeks in VA and is receiving state benefits (Medicaid & WIC) Advice? |

If the state of VA has a custody hearing in Oct...do i have to attend court in Texas at the end of this moth to give the child back to the mother?

have somebody appear at any sheduled hearing to argue that the other court has jurisdiction
