Default *This is an Emergency!*

My daughter's father dropped her off to live with me. We both have residential custody which was established three years ago in the state of NY, Long Island. He technicaly has residential custody of her now, but has initialy agreed to let her live with me. She has been acting out and her father wants to come pick her up TOMORROW. I have arranged for her to be in therapy and to be evaluated. I do not want her to go, but do not want to start a war either. What is in my best interest to do here? Do I lock the doors, call the police and not allow him to take her? Or do I let her go for now, and work throught the courts? If I let them take her, how would that effect my case? Please, I need help here, thank you.

Won't the father agree to let her go to the therapist? If he's looking out for her best interest he would, and there should be no problem letting her go. Maybe you need to discuss that with him.

I have discussed this with him and in the past he never thought that therapy was necessary and that in his words, it was a "crock". He is now claiming that he will get her into therapy but for the past several years he hasn't made any attempt. I already have her in therapy and have an appointment set for her to be evaluated. It was also stipulated in the court order that he get her evaluated which he never did.

You need to follow the order or get back in court asap to get a change made.
