My husband is leaving me because I became pregnant on our honeymoon and am 16 weeks along. He has a 7 year old from a previous relationship. I feel like I was tricked.How do I get any support from him while pregnant (I have been VERY sick and on IVs) He lives in Canada and I am in Oregon.

I wish to inform you that you can have spousal support and child support orders from court. As your husband is in Canada thus you may enforce your child and spousal support through Hague Convention. Alternatively you may file for spousal and child support in Canada. At present as child is not born thus you may have spousal support from court. In spousal support you may include special expenses towards your medical treatment.

In order to get a support order from him he needs to be personally served with process in the state in which you are residing. It is a jurisdictional issue. The alternative is to have him served in
Canada and proceedings brought and maintained in Canada which would, of course, necessitate your traveling to Canada to attend proceedings there. The advantage of a Canadian support order is that it can be enforced against his assets there AND also enforced against his assets in the U.S. I recommend you speak with a family law attorney, preferably one in Bellingham or Blaine, Washington who may be familiar with obtaining and enforcing familial orders between the U.S. and Canada. |
