When I was the custodial parent to my children I brought them to Australia. I then married an Aussie. (As i was the custodial parent, The U.S. Govt. did not require my x-husbands signature or permission for the children to gain access to a U.S. Passport.) After the children and I came to Australia I maintained contact between the children and their father. After 14 mos. had past I took the children back to North Carolina to visit with the Father. The Father then gained custody of the children through the courts by claiming they had been missing the whole time. I could prove he was lying in all the claims he had made before the magistrate but, my lawyer, wouldn't even take notice of my proof. My x-husband had even used digital photos of my children, which had been taken in Australia and sent via e-mail, For his web-site claiming the children as missing. That was 7 years ago. The Uniform Child Custody Jurisdiction Act "In Case of Emergency", I'm sure though i have never been told, that this law along with my x-husbands deceptions and lies are how he gained custody of my children. Can anyone help me? Even after all these years my heart still feels as though it were yesterday. I miss them so much. does anyone practice in or have experience with International Child Custody cases? Any advice would be helpful.
