dad changing custody because of phone call

I had my grand children here to visit me in Tx for 3 weeks. Thier dad sent 3 pair of shorts, shirts, underwear for 3 weeks. They spoke with him everynight
even if they used my phone. He has temporary custody of the kids and my
daughter called and I let her talk to the kids. When my husband went to Ohio to get them the dad had him to sign a paper saying that the kids would have not contact with my daughter. I let them talk to my daughter he did not and I did not sign the paper. Now we received a summons to appear in court to change the custody saying that we are to speak to the kids when we call and to have 3 weeks vacation yearly. While the children were here they spoke freely about how thier dad kicked them, smacked them in the face, and would punch them. How he drink all day long. I already spent over 9 thousand in attonery bills and never even seen a judge we only had a
over the phone hearing. Can this jerk win this case?

9000? you might change lawyers and get estimates for the bill or fix a fee.

He does have the primary rights to decide what to do...but is there an order as to your visits now? If so it will be somewhat hard for him to change it.
