I'm an American citizen, however, I have a Filipina friend that is having difficulty with her family at the present time. She is 17 and her mother wishes to kick her out of the house due to disagreements. What I want to know is whether or not this is legal in the Philippines. I've been looking around for the answer, and I've even tried reading through some of their codes, yet I have not had any luck in finding the answer.
It would be deeply appreciated if anyone here knew the answer to my question. |

I wish to inform you that till the time child is a minor till that time parent is liable to maintain child but after child turns adult the child is not under parents guidance and thus both can leave the premises and can live independently. Therefore after the child turns adult unless court otherwise orders a parent can make child leave premises. In this 18 years is the age of majority. If child is evicted before 18 years then also guardian can be held liable for acts of minor thus if minor is evicted after 18 years guardian will not be liable.

In the Philippines the age of majority was 21 -- unless the minor marries earlier. Until the law was recently changed. Here is the full text of the statute.
Republic Act No. 6809 AN ACT LOWERING THE AGE OF MAJORITY FROM TWENTY-ONE TO EIGHTEEN YEARS, AMENDING FOR THE PURPOSE EXECUTIVE ORDER NUMBERED TWO HUNDRED NINE, AND FOR OTHER PURPOSES. ![]() REPUBLIC ACT NO. 6809. AN ACT LOWERING THE AGE OF MAJORITY FROM TWENTY-ONE TO EIGHTEEN YEARS, AMENDING FOR THE PURPOSE EXECUTIVE ORDER NUMBERED TWO HUNDRED NINE, AND FOR OTHER PURPOSES. Section 1. Article 234 of Executive Order No. 209, the Family Code of the Philippines, is hereby amended to read as follows: "Art. 234.Emancipation takes place by the attainment of majority. Unless otherwise provided, majority commences at the age of eighteen years."Sec. 2. Articles 235 and 237 of the same Code are hereby repealed. Sec. 3. Article 236 of the same Code is also hereby amended to read as follows: "Art. 236.Emancipation shall terminate parental authority over the person and property of the child who shall then be qualified and responsible for all acts of civil life, save the exceptions established by existing laws in special cases. "Contracting marriage shall require parental consent until the age of twenty-one." "Nothing in this Code shall be construed to derogate from the duty or responsibility of parents and guardians for children and wards below twenty-one years of age mentioned in the second and third paragraphs of Article 2180 of the Civil Code."Sec. 4. ‘Age of majority ‘plays a vital role in deciding when a child to be kicked out of the house? Generally when a child attains age of majority he/she can be expelled from the house. In all cases the ‘Age of majority’ is treated as 18 years. So parents are bound to look after their children till they attains the age of majority. In Philippines it seems that the age of majority is 18. So the parents are answerable to the minors’ act.
