Alabama, Parental Rights? -- Custody of our nephew through a DHR case

We have custody of our nephew through a DHR case initially we had his sister as well when her father was established we lost custody of her and he now has custody of her we have no visits with her and do not get to see her at all the father turned around and left the baby with his parents and does not keep her..My question is if the mother signed over her rights of the baby to us would we be able to gain joint custody of her ?

I wish to inform you that court considers best interest of child as main consideration. In this regard if father is having custody of child then mother cannot sign over custody to you because she is not having any custody. In this mother will first have to take custody of child from court after which she may give you temporary custody. Parents of the child have first right to child custody therefore you cannot at present have joint child custody with father.
