My 9 year old has decided that she wants to talk to the Judge about her choice in living situations, but she doesn't want to do it in front of anyone (specifically her father) because she doesn't want to hurt anyone feelings in what she has to say. Will they allow it? Will they let her do it prior to our court date for change in child custody?

You have hit on just one of the problems with Family Court. The child's attorney usually pipes up opposite what the child says, and the judge goes with that.
However, as in a case of abuse; Family court has become a police state. Judges -Routinely- deny the accused their 6th Amendment right to confront. People have got to get reporters interested in covering the one court most often used, most often and for the longest period of time. Last edited by wld_team; Jul 30th, 2007 at 11:36 AM. |

You can ask; the court can allow it or may refuse. It is up to the judge.

Many states do allow the court to listen--but it is still up to the judge

Well, the Judge will talk to children here who are at least 6 years old and can show maturity. So, she will be allowed to talk to him alone, but with both lawyers present. She of course won't have the only say so, but the Judge will listent o what she has to say.

I am the original poster to this thread...I have spoken with my attorney and the child will be allowed to speak with the Judge privately with both attorneys present. She will be the last one heard at the hearing. Hooray!
