My ex-wife & I have been in and out of court in regards to our child custody case, nonetheless - the well being of our child. We have joint legal custody of our child. She has been ordered to move back into our state, after leaving without my consent - yet, keeps making excuses to the judge about how it would impossible because she doesn't have a job here and has no where to live. She also doesn't have her own transportation. She is currently residing with her mother (out of state), who naturally, provides her living arrangements (rent-free) and her transportation when our child comes to visit me. They are 4 hours away.
My child has spent the summer with me, since after our last court date in April, I agreed to (until a final judgment is made) keeping our child for the whole summer, and splitting holidays and extended weekends. Again, until there is a final judgment made - and/or, of course - my ex-wife moves back into the state. Then of course, there would be no problem with me visiting with our child on a (preferreed) alternate weekend basis. My child is twelve years old, and expressed to me that she feels that her life "is horrible" - and that she "never gets to do anything or have any fun"... keep in mind - this child resides with my ex-wife, and unfortunately, when with her, rarely talks to me on the phone. (I can never get a hold of my child when I call her (own) cell phone.) It breaks my heart to hear that, knowing that she's only twelve, and I know that she wasn't so negative when she was with me before they'd moved away (7 mos ago now). I do agree that she is always on "punishment/restriction" - and I don't agree that that could be anything positive for a child's confidence who is caught up in this unfortunate situation. I do feel that the ex-wife is ultimately manipulating, and I have mentioned that I feel that our child is being "brain-washed" by her. The ex-wife claims that all she ever does is "enforce <our child> to respect me" - yet, whenever we (the ex & I) are in an argument over the phone - our child is within earshot of all of the ex's degrating & derogatory remarks towards me. How do I go about getting the judge to order my ex to return our child back to me being that she has utterly disregarded his (the judge's) order and proclaim a 'final judgment' in our case?? Even if its just to get them to move back here once and for all? I sure have NOT given my consent, even still, to their living out of state. One more fact - there has been a warrant issued for my ex due to her contempt of judgment. Can I use that to my advantage and have her arrested? |
