Default Support Issues: My husband & I live in Missouri, and he pays for 2 kids in Virginia.

My husband & I live in Missouri, and he pays for 2 kids in Virginia. The oldest of the two turned 18 in December. This kid is autistic and was put into a home by his mother in March 2010, so he's been out of the house for over a year now. We want to drop him from the support. We have several issues here:

1. Can we have the jurisdiction for support moved to Missouri?

2. Can we have a telephonic appearance in court. We have NO money for my husband to travel there.

3. If the judge decides to NOT grant him a telephonic interview, can we cancel the whole proceeding since we are the ones that initiated this action in the first place?

4. WHY does it have to be so complicated to simply drop a kid who has turned of-age?? I don't understand that.

Answering your questions in order:

1. No. Virginia, the county in which the child is living has specific jurisdiction over the adult dependent. Missouri has no legal interest or right to determine his support and welfare.

2. Telephone hearings may be conducted in situations like this so I would ask the court, request the judge to set one.

3. Yes, your husband can drop any motion he brings, prior to the date of the hearing I would suggest so the court can reset its dockets rather than cancel at the last moment.

4. It may not be that complicated after all. The distance was probably your husband's choosing? To move from Virginia to Missouri? Just not as convenient as he would like, that's all.

We moved for a job & a better cost of living in 2006. We lived in northern VA in suburb of DC - outrageously expensive. We had a tiny apartment in a semi-ghetto area that we could barely afford.

My husband lost his job in Feb 2010. Through that, through moving, illness, & bankruptcy among other things, he has never missed one single payment.
