Default Last name change

If my daughter takes back her maiden name can her children use her maiden name as their own?

I do not think so with out the father signing the papers to say they can legally.

no, the children should use their legal name. if mom wishes to change it, she will need dad's permission

The kids don't want to change their last name they just want to be able to use there mothers last name. Their Dad would never allow them to legally change their last name.

They can use any name they wish with friends or family. However, at school, their Dr.s, sports, etc. they will have to use their legal names.

In this day and age, I don't understand all the fuss about children having the same last names as their mothers. I divorced and then remarried, my oldest had his father's name, it never bothered any of us that his name was different. This is usually the kind of thing that children won't make a big deal about as long as neither parent does either.
