Does a father have a legal right to watch his children instead of them having to go to daycare? My bofriend has told his ex that he will watch his kids while she works. Instead she wants to take them to daycare and have him pay his half for the daycare expenses? Does he have the option to watch them instead of paying daycare costs or is it the custodial parents choice. Nothing in his divorce decree says that he has the option, just that he needs to pay for his half of the expenses.

Yes he could ask the judge to change the order if she disagrees, and let him do the care.
Otherwise the order governs as closely as you can determine what is ordered. |
