Default Can't make it for the weekend visitation! Don't want to loose visitation %

California

Can the court penalize you and reduce your time with the kids (if oposing parent files a motion) if you have to miss visitation for one weekend even though you have been excedingly responsible with your visitation and responsabilities and up to current until now? I t is very important that I go out of town for 3 days and I can't really take them with me but I would hate that the judge would ding me for missing just one of my visitation weekends.

I wish to inform you that court considers best interest of child as main consideration. In this regard if just 1 visitation is missed then this will not affect child visitation schedule provided other parent was informed or sufficient provision was made so that child should not suffer. If child had not suffered then child visitation schedule will not be changed.

Visitation is a privledge not a right. You don't have to visit each time it is ordered. Sometimes things happen.The court will understand should the custodial parent try to make a fuss over it. You can't be condemned by court for missing one visitation.

Visitation is a right of both the parent and the child. Parents sometimes have to travel to meet requirements of their job -- the job they need to keep so they can keep supporting their self and family--whether living as a nuclear unit or divorced.

Just advise your ex of the pending business trip and see if the ex is ammenable to giving some extra makeup time. If the child is of age to understand, also let the child know why you won't be able to make the scheduled weekend visit.

To deprive a parent of time with their child also deprives the child of time they count on and need with their parent. I doubt any judge would be so harsh as to suspend or reduce time because a parent had to make a business trip over one weekend.

Rights to access and time with one's children rises to a Constitutional right, BTW. But one shouldn't have to go that far.

PS: Remember to bring back a little gift for your child.

Please stick to giving legal advice. Nobody is asking for your moral opinions or your "cutesy" suggestions.

Children have no rights. Therefore, it is incorrect to claim that visitation is a right a child possesses. It is not.

To answer the question, no. A judge will not reduce time.
